Beginning July 1, 2026, all Mobile Food Vendors in Texas will be required to obtain a statewide Mobile Food Vendor License issued by the Department of State Health Services (DSHS). City-issued mobile food licenses will no longer be issued or honored after this date.

About House Bill 2844

House Bill 2844 (HB 2844) was passed by the Texas Legislature on May 26, 2025, and signed into law by Governor Abbott on June 10, 2025. The bill establishes uniform statewide regulations for Mobile Food Vendors and becomes effective July 1, 2026.

Key Definitions

Mobile food vendors.

Any business which sells edible goods from a stationary location within the city. The term shall include, but not be limited to:

(1) Concession trailers. Vending unit which is pulled by a motorized unit and has no power to move on its own.
(2) Mobile food trucks. A self-contained motorized unit selling items defined as edible goods.

Mobile food unit or establishment.

The mobile food truck, concession trailer, or other motorized unit, including the equipment, supplies and apparatus, used on-site for the sale of edible goods.
